Right of withdrawal

INFORMATION ON THE RIGHT OF WITHDRAWAL

In compliance with the art. 52 of Legislative Decree 6 September 2005 n. 206 (Consumer Code), you have the right to withdraw from the contract signed with Tre.Mil. Srl (the seller) without any penalty and without having to provide any reason, within fourteen (14) days from the day you received the products purchased on StampaQualità.
The right to withdraw from the contract, in accordance with the art. 59 lit. c) of the Consumer Code, is no longer valid if the goods are tailor-made or clearly personalized.
The above information is provided in compliance with the art. 49 let m) of the Consumer Code, which requires the seller (StampaQualità) to inform the consumer that in the aforementioned cases there is NO possibility of exercising the right of withdrawal.

In compliance with the art. 54 of the Consumer Code, you can exercise the right of withdrawal using, at your choice, one of the following methods:
a) online transmission to the Seller of an email to info@stampaqualità.com; in this case, the Seller will send you confirmation by e-mail of receipt of the withdrawal declaration;
b) sending by mail to the Seller a form on the right of withdrawal compliant with the standard form pursuant to art. 49, paragraph 4, of the Consumer Code, to be completed in full;
c) sending by post to the Seller another explicit declaration of your decision to withdraw from the contract.
In cases b) and c) your declaration must be sent to the company headquarters, whose contact details are contained in the Conditions of Sale. It is understood that, in such cases, the burden of proving the correct and timely exercise of the right of withdrawal will be yours.
In compliance with the art. 57 of the Consumer Code, once the withdrawal from the contract has been exercised, the products to be returned must be delivered to the courier within fourteen (14) days from the date on which you communicated to the Seller your decision to withdraw from the contract.
In compliance with the art. 59 of the Consumer Code, the right of withdrawal is excluded not only if you have purchased tailor-made or personalized products but also when the customer has purchased sealed goods that are not suitable for return for hygienic or protection-related reasons. of health and were opened after delivery.

CONDITIONS FOR THE EXERCISE OF THE RIGHT EX ART. 52 CONSUMER CODE

The right of withdrawal is considered exercised correctly if the following conditions are fully respected:
to. the right of withdrawal must be regularly exercised within fourteen (14) days of receipt of the products following one of the methods indicated above;
b. the products must not have been used, worn, washed and, in any case, must comply with the requirements indicated in the art. 3, below, on the conformity checks of returned products;
c. the identification tag must still be attached to the products with the disposable seal which constitutes an integral part of the goods (see Article 5 below in this regard);
d. the products must be returned in their original packaging (if you want to return a kit, you must return all the items that make it up);
And. the returned products must be delivered to the courier within fourteen (14) days from when you communicated to the Seller your decision to withdraw from the contract;
f. the products must not be damaged.
If you have complied with all the required conditions, the Seller, in accordance with art. 56 of the Consumer Code, will refund you in full the price of the products purchased, with only the return costs being your responsibility, i.e. those for returning the purchased products to the Seller, unless the Seller has expressly exempted you from such costs at time of purchase.

CONFORMITY OF RETURNED PRODUCTS

You will be contacted if your return cannot be accepted because it does not comply with the conditions set out in the letters. a) and e) of the previous paragraph or in the case referred to in art. 59 of the Consumer Code and you can choose to have the products purchased back at your expense. If you refuse this shipment, the Seller reserves the right to retain the products and the amount corresponding to the purchase price of the products.
All products must be returned new and unused, in perfect condition, with all protective materials and with identification tags and stickers attached to the products (if any), as well as their packaging, accessories and documentation. If the product shows signs of use or if it has been used or altered from its original condition in any way, the Seller reserves the right not to accept the return or, alternatively, to reduce the amount of the refund or exchange consequentially.
For example, the Seller may make a reduction in the refund in the following circumstances:
• the products have been used, worn, damaged or washed;
• the identification tag is no longer attached to the products with the disposable seal or has not been returned. Please note that the identification tag is an integral part of each product; and/or
• the original packaging which is an integral part of the product (e.g. the protective bag) has not been returned;

You will be contacted if the Seller decides to deduct the refund for this reason. In this case, you can choose (as an alternative to deducting the refund) to have the products purchased back at your expense. In this last case, if you refuse the shipment, the Seller will have the right to retain the products and the amount indicated for the reduction of the refund, due to the decrease in value of the returned products.
It remains clear that the Seller assumes no responsibility in the event of products returned by mistake or objects forgotten in packages or returned products.

NON-COMPLIANT PRODUCTS

Without prejudice to the application of mandatory consumer protection regulations, you can return a product because it is affected by defects or does not conform to what was ordered, by informing the Seller within thirty (30) days from the day on which you received the products purchased on StampaQualità, through the contacts indicated in the Conditions of Sale.
StampaQualità will check the products you have returned because they are affected by defects or do not conform to what you ordered and will proceed with a full refund, including shipping costs and the costs you incurred to return the products to StampaQualità.
In the event that StampaQualità does not detect any defects or lack of conformity in the returned products, you will be informed that your return cannot be accepted and you will be able to choose whether to receive the purchased products back. If you refuse the shipment, StampaQualità will have the right to retain the products and the amount corresponding to the purchase price of the products, as well as reserves the right to request the costs incurred.

CONDITIONS FOR THE CHANGE

In some cases, as specified below, you will have the possibility to exchange the products purchased with others of the same model, having a different size and/or colour. The exchange of products will be possible only if the products in the selected size and/or color are available at the Seller's warehouses.

The exchange request will take place within the limits set out below:

  • Only those products purchased may be subject to exchange, for which this possibility will be expressly provided for in this information on the Right of Withdrawal;
    • you can request the exchange of one or more products purchased only with products of the same model, having a different size and/or colour;
    • you will be able to request the exchange of one or more products purchased no later than fourteen (14) days from the date of their delivery, by contacting the Seller directly, to be made within the aforementioned deadline. The products to be exchanged must be delivered to the courier within fourteen (14) days from when you communicated to the Seller your decision to exchange the products;
  • you can only make one exchange request for each product purchased;
    • the products for which you request an exchange must be returned to StampaQualità in their original packaging, unused, worn, washed or damaged, and the identification tag must still be attached with the disposable seal;
    • the products to be exchanged which are part of a single order must be sent to StampaQualità in a single shipment. StampaQualità, in fact, reserves the right not to accept products from the same order, sent for exchange at different times.

If all the conditions mentioned above are correctly respected, StampaQualità will take care of the same replacement request by sending you a confirmation email to this end.
After StampaQualità has received the products you intend to exchange and checked that all the above requirements have been respected, StampaQualità will verify the actual availability of the products in the size and/or color you indicated in its warehouses.
In the event that the product or products selected for the exchange are not available in its warehouses, StampaQualità will not be able to accept your exchange request and will therefore proceed to refund the price of the product or products originally purchased and not replaceable, in accordance with the provisions provided for by the Consumer Code and according to the methods set out above.
In the event that the product or products selected for the exchange are available, StampaQualità will be able to accept your exchange request and will therefore proceed to send you an email confirming the shipment of the replacement products. In this case, the shipment will take place within thirty (30) working days from the date on which StampaQualità becomes aware of your exchange request. The shipping costs of replacement products will be borne by StampaQualità.
If the price of the product purchased is lower or higher than the price of the product selected for the exchange, you will not be granted any refund and/or charge for the difference. However, it remains understood that, as an alternative to requesting product replacement, you can exercise your right of return in accordance with the Consumer Code.
You will be contacted if your exchange request cannot be accepted because it does not comply with the conditions set out above. In this case, you can choose to have the products you intended to exchange back at your own expense. If you refuse this shipment, StampaQualità reserves the right to withhold the products and may also withhold the amount corresponding to the purchase price of the products themselves, or the amount indicated for the reduction of the refund, due to the decrease in value of the returned products, as indicated above.

The replacement product or products may be subject to subsequent return pursuant to art. 52 of the Consumer Code.

COMPLIANCE OF THIS INFORMATION WITH THE CONSUMER CODE

These Conditions for the exercise of the right of withdrawal, forming an integral part of the General Conditions of Sale, are governed by Italian law and in particular by the Consumer Code.
